Privacy Policy

In this Privacy and Personal Data Protection Policy (hereinafter – the “Policy”), the procedures for the processing of personal data are defined, including the types of personal data collected, the purposes for which such personal data is used, the Company’s interaction with third parties, the security measures implemented to protect personal data, the conditions for access to personal data, as well as the contact information available to Data Subjects for requesting information.

This Policy does not apply to the activities of companies that are not owned or controlled by the Company, nor to individuals who are not managed by the Company.

1. Definition of terms

The following terms are used in this Policy:“Services” / “Platform Services” / “Products” — the tools and materials developed and provided on the INBOOST platform for creating, storing, sending, and managing communication with the Participant’s end users.“Participant” — an individual or organization, a user of the Services, registered on the INBOOST web platform as a business entity.INBOOST Web Platform — a service for creating a personal chatbot for business companies. The author, developer, owner, and controller of the personal data database of the Participants of the INBOOST platform is IKEIS4BIZ LLC (hereinafter – the “Company”), a legal entity registered under the laws of Ukraine, located at: 36039, Poltava region, Poltava city, 19A Olesia Honchara Street, office 301, EDRPOU code 42621521.“End User” — an individual with whom the business company communicates or may communicate in the future using the Services. In other words, this is a user whose personal data is added to a client card (account) or whose information has been uploaded to the INBOOST web platform.“Personal Data” / “Personal Information” — any information that directly or indirectly identifies the Participant, including but not limited to: first name, last name, phone number, date of birth, email address, browser language, gender, profession, and other demographic details.

2. General provisions

This Policy explains what information is collected on the INBOOST web platform, why it is collected, to whom it may be transferred, and how such information can be updated, exported, or deleted.
By registering on the INBOOST web platform, each Participant and their End Users agree to and accept the terms of this Policy and other related documents, and give their consent to the collection, processing, and transfer of personal data in accordance with the conditions described in this Policy.
By registering on the INBOOST platform or using the web platform in any manner, the Participant represents and warrants that they have the right, authority, and capacity to accept these Terms (on their own behalf or on behalf of the entity they represent). This means that the Participant represents and warrants that they have reached the age of majority required to enter into this agreement, or, if they have not reached the age of majority, they have obtained the consent of a parent or legal guardian to enter into this agreement on their behalf.If the Participant is acting as an organization or other legal entity, they represent and warrant that they are duly authorized to do so.
The INBOOST web platform does not collect any information for which the legislation establishes special processing requirements, such as information about racial or ethnic origin, political opinions, religious or philosophical beliefs, membership in political parties and trade unions, criminal convictions or criminal proceedings, as well as data relating to health, sex life, biometric or genetic data (in accordance with Article 7 of the Law of Ukraine “On Personal Data Protection”).
The terms of this Policy may be amended or supplemented by the Company unilaterally without any special prior notice to Participants or the End Users of the chatbot. Any amendments or supplements shall become effective on the date of their publication.
The current version of this Policy is available on the INBOOST web platform.
Participants of the platform are advised to regularly review the terms of the Policy for any changes or updates. Continued use of the platform after amendments or supplements have been made to the Policy constitutes acceptance and full agreement of the Participant or End User with such amendments or supplements.

3. Data provided by the Participant or End User of the chatbot

This section describes what information is collected on the INBOOST web platform. Information provided by the Participant when creating an account includes:● first name;● last name;● email address;● company name;● IP address;● phone number;● Facebook account used for authorization.

Information provided by the End User when creating an account includes:● first name (if available);● last name (if available);● nickname (if available);● profile photo (if available);● time zone (if available);● geolocation (if permitted);● phone number;● email address;● other information that may be displayed when creating an account in the chatbot.

The data may also include gender, profession, place of residence, purchase history, and other information necessary for the provision of the Services.By providing information about themselves, the Participant and/or the End User agrees that the information provided is collected, used, transferred, stored, and disclosed by the Company in accordance with the rules described in other sections of this Policy.

4. Data collected automatically

Each time a Participant accesses the platform, it automatically receives and records information about the Participant’s actions on the resources, use of the Services, network activity, and more. Such information may include the IP address, operating system, browser name and ID, visit history, and data regarding interactions with other services. Data collection is carried out through log files, cookies, and other tracking technologies.
The Company processes, uses, and manages the information solely on lawful grounds.

5. Purpose of using personal data

The Company may use and disclose personal information for the following purposes:● administering the INBOOST web platform;● providing access to the Services available on the INBOOST web platform;● sending informational and promotional content;● issuing invoices and sending payment reminders to Participants of the INBOOST platform;● participation in contests;● sending system notifications;● clarifying account information and providing support to Participants;● ensuring the security and protection of the rights of Participants, third parties, and the Company;● complying with legal requirements and executing court orders, requests, and other legal processes;● providing information to the Company’s representatives and advisors, including lawyers and accountants, who ensure compliance with applicable legislation, accounting standards, and security requirements;● initiating claims and defending the Company’s interests in legal proceedings, disputes, and other judicial processes;● responding to requests from governmental authorities, including for purposes of national security and law enforcement compliance;● providing, maintaining, and improving the offered Services.

6. Disclosure of personal information to third parties

The Company does not transfer personal data to third parties, except in cases where such transfer is required by law enforcement authorities, pursuant to a court order/decision, or as part of other lawful procedures, or in response to any other legitimate request in accordance with the applicable laws of Ukraine, as well as in other cases described in this Policy.

7. End User Data Provided by the Participant

Using the chatbot, Participants import personal data collected about End Users into the INBOOST web platform. The Company does not cooperate with the Participant's End Users directly, therefore it is not responsible for the presence or absence of appropriate permission (explicit consent) for the collection and processing of personal data about these individuals by the Participant.

8. Participants' rights regarding personal data

8.1. Right of access

This Policy lists the data collected and the purposes for which that data is used. A Participant or any End User may contact the Company directly to request access to the information stored.

8.2. Right to rectification

At any time, the Participant has access to his/her Client Card on the INBOOST chatbot platform, where he/she can update, correct, and supplement information about himself/herself or his/her End Users upon request. The participant may also contact INBOOST platform support with a request to access, correct, change or delete their information.
The Company will provide the Participant or End Users with access to personal data stored in the service within 30 days from the date of the processed request. 9. Data accuracy and retention

The INBOOST Platform will retain personal data provided by Participants and End Users for as long as necessary to provide our services or fulfill our legal obligations, resolve disputes, prevent misuse, or enforce our agreements.
In case of changes to personal data, the Participant is responsible for not notifying the Participant of this. The INBOOST platform will store the information as long as your account is valid or as long as you use the services of the INBOOST web platform.

10. Protection of personal data

The Company takes all necessary measures to protect the personal data of Participants from unauthorized access, alteration, disclosure or destruction.

11. Information storage

Personal data is stored for no longer than is necessary for the purpose of processing. After a corresponding request to the Company, the Participant may delete his/her account on the INBOOST web platform, after the Company agrees to this, all personal data of the Participant will be deleted automatically.
